1. Introduction

Welcome to the Tommee Tippee South Africa Affiliate Marketing Program (“Program”). By signing up as an affiliate (“Affiliate”), you agree to comply with these Terms & Conditions. Tommee Tippee South Africa (“Company,” “we,” “us,” or “our”) reserves the right to modify these terms at any time. Any updates to these Terms & Conditions will be available via this application and upon request. Continued participation in the Program constitutes acceptance of any changes.

2. Eligibility

• Affiliates must be at least 18 years old.
• Applicants must have an active website, blog, or social media presence aligned with our brand.
• We reserve the right to approve or reject any application at our discretion.

3. Affiliate Responsibilities

• Promote Tommee Tippee South Africa products in a positive and ethical manner.
• Do not engage in misleading, deceptive, or spammy marketing practices.
• Affiliates must comply with all relevant South African laws and regulations, including the Protection of Personal Information Act (POPIA).
• Do not bid on “Tommee Tippee” branded keywords in search engine advertising.
• Affiliates may not use coupon or discount websites to promote affiliate links.
• Affiliates are prohibited from impersonating Tommee Tippee through display ads unless authorized.
• No content, whether paid for or not, should be labeled as #Ad unless applicable. Non-compliance may result in commission rejection and removal from the program.

4. Commission & Payments

• Affiliates earn a commission on valid sales generated through their unique affiliate link.
• Commission rates and structures are subject to change at our discretion.
• Payments will be made when the Affiliate has reached the minimum payout threshold of R100 AND after 30 days.
• Payments are processed via EFT to a South African bank account.
• Returns, refunds, or fraudulent transactions will result in commission reversals.

5. Cookie Tracking

• Sales will be tracked via cookies with a 30-day tracking period.
• If a customer clicks on multiple affiliate links, the commission will be awarded to the last referring Affiliate.

6. Voucher Code Use

• You may only promote voucher codes provided through the Tommee Tippee Affiliate Programme.
• Non-authorized voucher codes should not be used, and we reserve the right to withhold commission for any sales involving unauthorized codes.
• Voucher codes should be clearly marked as expired after the expiry date unless advised otherwise.

7. Intellectual Property Rights

• Affiliates must respect the intellectual property rights of Tommee Tippee, including trademarks, copyrights, domain names, and goodwill rights.
• Any infringement of these rights may lead to removal from the program, and Tommee Tippee may retain any commission due to the affiliate.

8. Paid Search Activity

• Affiliates are prohibited from using certain keywords in paid search activities, including:
  • Brand-related terms like “Tommee Tippee,” “TommeeTippee.co.za,” and any misspellings.
    Domain names resembling Tommee Tippee or any unauthorized use of our trademarks.
  • Affiliates must add Tommee Tippee keywords as negative keywords in their PPC campaigns.
  • Affiliates are also prohibited from using Tommee Tippee branding in URLs, such as www.affiliatexyz.com/tommeetippee.

9. CSS Activity & Domain Name Restrictions

• Affiliates may not register domain names similar to the Tommee Tippee brand or use our domain names for PPC linking without express permission.

10. Creative and Linking

• Do not hardcode creative content into sites to avoid outdated information.
• Links should be taken directly from the linking methods section of the affiliate account.
• Affiliates are prohibited from impersonating Tommee Tippee with our creatives.

11. Restricted Activities

Affiliates are strictly prohibited from:

• Using “Tommee Tippee” trademarks or branding without prior written approval.
• Creating false or misleading advertisements.
• Engaging in unethical marketing tactics such as clickbait or false endorsements.
• Promoting Tommee Tippee products in a manner that could damage the brand’s reputation.
• Displaying expired voucher codes or promoting codes not authorized by Tommee Tippee.

12. Termination

• Either party may terminate this agreement at any time with 24 hours written notice.
• We reserve the right to terminate an Affiliate’s account immediately for any breach of these Terms & Conditions.
• Upon termination, any outstanding commissions may be forfeited if the breach caused the termination.
• In cases of severe breach, Tommee Tippee reserves the right to immediately suspend any affiliate, reversing any commissions accrued.

13. Liability & Indemnification

• Tommee Tippee South Africa is not responsible for any losses or damages incurred by Affiliates.
• Affiliates agree to indemnify and hold harmless the Company from any legal claims arising from their participation in the Program, in accordance with South African law.

14. Amendments

• We reserve the right to update these Terms & Conditions at any time.
• Continued participation in the Program constitutes acceptance of any changes.

15. Governing Law

These Terms & Conditions shall be governed by and construed in accordance with the laws of South Africa.
